In our previous post, which you can read by clicking Renton Wa Landlord Insurance, we find that Ted’s $50,000 plus in water damages will not be covered by his insurance company!

One of the tenants had flushed a small teddy bear down the toilet causing the plumbing to be stopped up, which led to hundreds of gallons of water pooling in the upstairs men’s bathroom, which in turn led to the collapse of the floor and ceiling.

Ted is miserable. He is looking at needing to spend much of his savings to pay for the damage.

Why did the insurance company deny Ted’s claim? If you recall from an earlier post, we discovered that Ted decided to purchase the Basic Causes of Loss Landlord Policy Form for his apartment building insurance.

Ted did this because he was concerned about the price. In hindsight, however, Ted realizes he made a monumental mistake that now will cost him over $50,000!

The Basic Causes of Loss Landlord Policy Form extends coverage only for the following named perils: lightning, explosion, smoke, windstorm, hail, riot, civil commotion, aircraft, vehicles, vandalism, sprinkler leakage, sinkhole collapse, and volcanic action.

Did you notice that flooding and water damage are not named in this list of perils (with the specific exception of leakage due to sprinklers, which does not apply here)?

Unfortunately for Ted, water damage due to flooding, whether from sources within or without, is not covered by the named perils in his Basic Causes of Loss Landlord Policy Form.

This means that Ted is responsible for paying for the repairs – a sum of over $53,811 – out of his own pocket.

$53,000 out-of-pocket is certainly no small chunk of change.

This illustrates perils that real estate investors can potentially create with their commercial insurance. We would like to briefly discuss one other potential issue that you can face as a real estate investor.

In our fictitious scenario that we discussed with the water claim at Ted’s owned apartment building, what would have happened if his building burned down to the ground under the Basic Causes of Loss Landlord Policy Form?

Fire is one of the named perils in the policy so coverage would have been extended up to his policy limits.

However, another pitfall that real estate investors run into is the Ordinance or Law Coverage Option, because it may be missing from your policy.

If this coverage option is missing from your policy you can quickly find yourself in a situation where you may spend just as much money as Ted spent out-of-pocket in the event of a covered claim.

The Ordinance or Law Coverage Option will add coverage to your policy to reimburse you for additional repairs you may need to make to comply with local laws regulating construction and repair of damaged buildings.

Because Ted’s building is very old – built sometime in the early sixties and renovated in the late sixties – it is not up to current building code.

When a structure is severely damaged it will be required to be brought up to the most updated safety code standards for that area (they can differ from area to area).

Ordinance or Law Coverage is not an automatic coverage; it must be endorsed to the policy.

A real estate investor can find themselves in a deep hole financially if the Ordinance or Law Coverage option is not part of your overall insurance plan so make sure to ask about that when you call for information or quotes on Landlord Insurance in Seattle Washington.
